Bespokeonline.uk is a sales platform for buyers and sellers. It is neither buyer or seller. The legal contract is between the buyer and seller and not Bespokeonline.uk

Selling online and distance selling

The following MUST be adhered to and forms part of the agreement between the seller and buyer. You, as the seller agree to:

  1. An item or items must be posted to the buyer within three days (unless it is a commissioned piece where both parties agree on postage and completion dates. Insurance is the responsibility of the seller and should be included in the cost specified, together with any special delivery charges.
  2. The buyer should be given your address (even if this is a home address). It is illegal not to provide this information.
  3. If the buyer wishes to cancel the transaction they must send the item back and you must provide a refund within 14 days. You can deduct monies if the goods are reduced in value due to use or treatment plus wear and tear (take photographs as evidence of condition). Commissioned orders are exempt from cancellation unless they are faulty.
  4. Returns policy for non faulty goods: By using Bespokeonline.uk you agree that the buyer has the right to end the contract and return item(s)even if it or they are not faulty, within 14 days of receipt and a refund must be paid within 14 days of you receiving the returned goods, or proof of the buyers having sent the goods back, whichever is earliest. The buyers pays return postage. Commissioned orders are exempt from cancellation unless faulty.
  5. Faulty goods: The customer has the right to return faulty goods up to six months after receipt. During this period the customer may be entitled to a free repair, full or part refund or a replacement.
  6. Lost in transit: Unless proven otherwise, the contract is assumed terminated. You must re-deliver the same item or provide a refund.

DATA PROTECTION

These regulations apply to ALL sellers on Bespokeonline.uk if you collect and process personal data (eg customer name, address and email address) regardless of your seller status (sole trader, limited company, partnership or hobbyist) you MUST comply with these regulations:

If you sell on Bespokeonline.uk you agree to comply with these regulations now and with any changes. They include:

  1. Only using personal data for the specific purpose you have collected it for. You must NOT use the data for anything other than the purchase or customer interaction by them at their instigation.
  2. Make sure any personal data is stored safely on and offline.
  3. If requested, you must delete someone’s personal data this is “the right to be forgotten”. If such a request is made you have one month to do this.
  4. Only add customers to your mailing list if you have their specific agreement and evidence of this. ie they must opt in.
  5. Bespokeonline.uk is not responsible for, or involved in the collection of personal data from purchasers and the seller is wholly responsible for this activity and compliance.
